Createch Evaluator Portal — Terms of Use

1. Agreement to these terms
These Terms of Use (the "Terms") govern your access to and use of the Createch Evaluator Portal at sbs.createch.app (the "Portal"), operated by Createch, LLC, a North Carolina limited liability company ("Createch", "we", "us").
By creating an account or using the Portal you agree to these Terms. If you do not agree, do not use the Portal.
2. What these Terms are, and what they are not
These Terms govern your use of the website. They do not govern the work.
If your application is approved and you sign the Independent Contractor Service Agreement and its state-specific addendum, that agreement — together with any Project Order you accept — governs the engagement itself: what you are paid, what you must deliver, confidentiality, intellectual property, and how disputes about the work are resolved.
Where these Terms conflict with the Independent Contractor Service Agreement, that agreement controls. These Terms then apply only to matters they alone address, such as acceptable use of the website.
3. Using the Portal is not an offer of work
Creating an account, submitting an application, and completing any part of the process do not create an engagement, guarantee work, or oblige Createch to offer you anything.
Createch may decline any application for any lawful reason, or for no reason. Approval of your application is not a guarantee of task volume, hours, income, or duration of engagement.
You must also complete training and pass a scored calibration assessment before you receive live work. Passing is not guaranteed.
4. Eligibility
To use the Portal you must:
- be 18 years of age or older;
- be legally authorised to work in the United States as an independent contractor;
- reside in the United States;
- provide accurate, current, and complete information; and
- have the legal capacity to enter into a binding contract.
The Portal is intended for adults only. If we learn that a person under 18 has created an account, we will close it.
5. Your account
You are responsible for:
- keeping your password confidential;
- everything that happens under your account;
- notifying us immediately at info@createch.app if you suspect unauthorized access.
One person, one account. Do not share your credentials with anyone, and do not let another person use your account or complete any part of your application or work on your behalf. Credentials are personal and non-transferable.
We may suspend or close an account that we reasonably believe is shared, fraudulent, duplicated, or created with false information.
6. Acceptable use
You agree not to:
- provide false, misleading, or another person's information, including another person's identity document;
- impersonate any person or misrepresent your affiliation with anyone;
- use any automated means — bots, scrapers, crawlers, scripts — to access the Portal;
- attempt to probe, scan, or test the vulnerability of the Portal, or breach any security or authentication measure;
- access any account, data, or area of the Portal you are not authorised to access;
- interfere with or disrupt the Portal, or impose an unreasonable load on it;
- copy, reproduce, or redistribute any part of the Portal or its content, except material we expressly provide for your own use;
- upload malicious code, or any file that is not what it claims to be;
- reverse engineer, decompile, or disassemble any part of the Portal; or
- use the Portal for any unlawful purpose.
Where you are given access to evaluation guidelines, task content, or training material, additional obligations apply under the Independent Contractor Service Agreement — including a prohibition on using generative artificial intelligence to produce any part of a submission, on sharing task content, and on discussing the programme publicly.
7. Information and documents you submit
You confirm that everything you submit is accurate, and that any identity document you upload is your own, genuine, and unaltered.
You grant Createch a limited, non-exclusive, royalty-free licence to use, store, and process what you submit solely to operate the Portal, verify your identity, evaluate your application, administer onboarding, and meet legal obligations. We claim no ownership of your personal information.
Submitting a forged, altered, or another person's identity document may be a criminal offence and will result in immediate closure of your account.
How we handle your information — including how long we keep identity documents and how to exercise your privacy rights — is set out in our Privacy Policy at https://sbs.createch.app/privacy, which forms part of these Terms.
8. Electronic records and signatures
By using the Portal you consent to transact electronically and to receive all records, notices, and disclosures relating to your application electronically.
Where the Portal asks you to sign a document, your typed name and your click on the signing control constitute your electronic signature, and have the same legal effect as a handwritten signature under the federal ESIGN Act and applicable state UETA equivalents.
For each signature we record the exact version of the document signed, the date and time, your IP address, and your browser user agent. You may download a copy of anything you sign at any time from your account, and may request a paper copy by writing to info@createch.app.
To access and retain electronic records you need a current web browser, an active email account, and the ability to view and save PDF files.
You may withdraw your consent to transact electronically by contacting info@createch.app. Because the Portal operates entirely electronically, withdrawing consent means you cannot continue to use it, and any pending application will be closed. Withdrawal does not affect the validity of anything already signed.
9. Third-party services
If your application is approved, your contractor payment profile is created in Gusto, a separate payroll platform. Gusto collects your bank details and tax information directly from you under its own terms and privacy policy. Createch does not control Gusto and is not responsible for its services.
Createch will never ask for your Social Security number, bank account details, or tax forms through this Portal, by email, or by text. If you receive such a request appearing to come from Createch, do not respond — report it to info@createch.app.
10. Our intellectual property
The Portal, its design, text, graphics, and software are owned by Createch or its licensors and are protected by intellectual property law. We grant you a limited, revocable, non-transferable licence to use the Portal for the sole purpose of applying for and, if approved, participating in the programme. All other rights are reserved.
11. Availability and changes
We may modify, suspend, or discontinue the Portal or any part of it at any time, with or without notice. We do not guarantee uninterrupted or error-free availability, and we are not liable for any unavailability.
12. Suspension and termination
We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have breached these Terms, provided false information, or used the Portal unlawfully — or for any other lawful reason.
You may close your account at any time by contacting info@createch.app. Closing your account does not automatically delete records we are required to keep; see the Privacy Policy.
Sections 7, 10, 13, 14, 15, 16, and 17 survive termination.
13. Disclaimers
The Portal is provided "as is" and "as available". To the fullest extent permitted by law, Createch disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Portal will be uninterrupted, secure, or error-free, or that defects will be corrected.
Some states do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, Createch and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to your use of the Portal — whether based in contract, tort, negligence, strict liability, or otherwise, and even if advised of the possibility.
Our total aggregate liability arising out of or relating to the Portal will not exceed the greater of $100 or the total amount Createch has paid you in the twelve months preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, for wilful misconduct, or for gross negligence. Some states do not allow certain limitations, so some may not apply to you.
This Section does not apply to disputes about the work itself, which are governed by the Independent Contractor Service Agreement and its state-specific addendum.
15. Indemnification
You agree to indemnify and hold harmless Createch and its officers, members, employees, and agents from any claim, demand, loss, liability, or expense — including reasonable attorneys' fees — arising from your breach of these Terms, your misuse of the Portal, or your violation of any law or third-party right. This does not apply to the extent the claim arises from Createch's own negligence or wilful misconduct.
16. Governing law and venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles, and you consent to the exclusive jurisdiction and venue of the state and federal courts located in Wake County, North Carolina, for any dispute arising from your use of the Portal.
This does not apply to disputes about your engagement. Those are governed by the dispute-resolution, governing-law, and arbitration provisions of the Independent Contractor Service Agreement and the state-specific addendum for your state of residence — which, for several states, require that state's law and venue and cannot be overridden here.
Nothing in this Section deprives you of the protection of any non-waivable right under the law of your state of residence.
17. Changes to these Terms
We may update these Terms. When we do, we will update the "Last updated" date. If a change is material we will give notice by email or through the Portal before it takes effect. Continuing to use the Portal after a change takes effect means you accept the revised Terms. If you do not accept them, stop using the Portal and contact us to close your account.
18. General
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Createch regarding the Portal, and supersede any prior understanding about it.
Severability. If any provision is held unenforceable, the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them to an affiliate or successor.
Notices. We may give notice through the Portal or to the email address on your account.
Accessibility. We aim to meet WCAG 2.1 Level AA. If you have difficulty using the Portal or need an accommodation to apply, contact info@createch.app and we will work with you.
